The Consumer Product Safety Improvement Act of 2008 was legislated on 14 August 2008 that

The new Consumer Product Safety Improvement Act, due to be in force by stages, requires1 K% i. d5 t- A- J& }' t7 G
mandatory third-party testing of products intended for children aged 12 and under covering a( k% w2 [6 M- ?; i( R( L% R
broad spectrum of product categories, including toys, furniture, baby cribs, pacifiers, children’s
9 o- l Z2 u+ k( hmetal jewellery, baby carriers, high chairs, strollers, walkers, swings and cradles.3 ?7 N7 G- ?1 q( a
The Act will ban the sale of consumer products that contain excessive amount of following7 F$ [* R+ P$ a. Z7 q
substances by the respective effective dates:
C( W+ {/ a+ u ]- Total lead content by weight for any accessible part of children’s product through5 t2 k7 d- W0 T) G8 C3 X
reasonably foreseeable use and abuse e.g. swallowing, mouthing, breaking, or other( b0 i i5 t* L
children’s activities, and the aging of the product:
4 y8 _/ P" e' S6 a3 a& ^6 K4 eo more than 600ppm (beginning 10 February 2009);
8 A0 `& H; P4 k0 Q& L6 I8 H% qo more than 300ppm (beginning 14 August 2009);+ \5 Z; h, h9 F% C" o
o more than 100ppm (beginning 14 August 2011);8 }$ O9 @: X1 r8 T- a+ M
- Lead in paint and surface coating in max concentration of 0.009% or, more than 2μg
; u4 o5 f3 o8 S xof lead in a total weight ≤ 10mg of paint or other surface coating or in a surface area ≤, X0 M" e' ^& I; [4 w
1cm2 (beginning 14 August 2009);9 X! k2 v8 y" E
- Phthalates (DEHP, DBP or BBP) in concentrations exceeding 0.1% by weight of" x( M9 B( r( S5 B
children’s toy or childcare article, or phthalates (DINP, DIDP or DnOP) in
1 G7 t( U3 G% V9 gconcentrations exceeding 0.1% by weight of children’s toy that can be placed in a. g& w: M6 N" h
child’s mouth or childcare article (beginning 10 February 2009).
4 G7 B$ k& U+ I4 O& ?4 r5 i2 fThe Act also specifies ASTM F963-07 Consumer Safety Specifications for Toy Safety as
7 B2 C4 k3 _* z0 B* Wmandatory standard under the Consumer Product Safety Act and demands rulemaking process for0 b- _; r5 B+ T' i+ Y" T
12 specified durable nursery products for use by children under the age of five years.
: ]% d. c4 [2 Z' B1 e% IThe Act further requires that children’s product and its packaging should come with a tracking1 g: p: B6 N r! ^+ S' {# X% i6 o
label that allows officials to trace a product back to its factory in the event of a recall. Any" h: t5 z; |9 x; P) W) B
advertisement for direct marketing shall carry appropriate cautionary statement for product that
7 S1 L4 m5 T/ n5 zrequires such information.2 ~$ J7 L U7 a
Civil penalties for violation of any CPSC regulations are increased from US$5,000 to6 W* y+ l3 }0 T& W0 Y
US$100,000 for individual violation or up to US$15 million for violations involving multiple8 C) @1 x- D- U: M. }* o
