The Consumer Product Safety Improvement Act of 2008 was legislated on 14 August 2008 that
! l% G! A5 Y* k: [; Z i2 Gregulates the manufacturing and testing of imported consumer goods in the US.
( ^( _5 M* Z6 ^: |4 JThe new Consumer Product Safety Improvement Act, due to be in force by stages, requires: l; L3 x! q2 n$ ]
mandatory third-party testing of products intended for children aged 12 and under covering a
% m) `& l) r; t& obroad spectrum of product categories, including toys, furniture, baby cribs, pacifiers, children’s
0 W% G6 N9 H& \+ zmetal jewellery, baby carriers, high chairs, strollers, walkers, swings and cradles.
: _4 n0 N) F% \( ?; `; K* |4 [$ c$ l/ KThe Act will ban the sale of consumer products that contain excessive amount of following# X8 ~3 [; Y, E, v& ^( F2 Y
substances by the respective effective dates:
7 Y/ I' i# n- G# l# E- Total lead content by weight for any accessible part of children’s product through
& [7 {! o* s8 q* Ereasonably foreseeable use and abuse e.g. swallowing, mouthing, breaking, or other% K* M9 y: ^6 e' Y2 W0 `- G7 `
children’s activities, and the aging of the product:' t) O5 V) p3 Y
o more than 600ppm (beginning 10 February 2009);4 r; j, M2 G" c1 M/ V3 B* W
o more than 300ppm (beginning 14 August 2009);
: O+ Z( m8 ]) t5 n# y g( m* ^o more than 100ppm (beginning 14 August 2011);
! [! r* w5 y3 h; d) n; Q" E- Lead in paint and surface coating in max concentration of 0.009% or, more than 2μg' v6 a0 c/ o. h( U' ^) ~
of lead in a total weight ≤ 10mg of paint or other surface coating or in a surface area ≤
3 T& o/ ^& w, e5 W% a1cm2 (beginning 14 August 2009);, w1 @8 l7 ]' ^% o( o
- Phthalates (DEHP, DBP or BBP) in concentrations exceeding 0.1% by weight of! z, W( ^6 Q; }: R$ I
children’s toy or childcare article, or phthalates (DINP, DIDP or DnOP) in
8 Q# Y/ V5 u3 v) C( Jconcentrations exceeding 0.1% by weight of children’s toy that can be placed in a
+ m/ B/ s' p$ Hchild’s mouth or childcare article (beginning 10 February 2009).
( y% ?6 T9 D. }" L1 L# LThe Act also specifies ASTM F963-07 Consumer Safety Specifications for Toy Safety as
8 m' @ O, H0 G# dmandatory standard under the Consumer Product Safety Act and demands rulemaking process for5 _, G: O- \- i j# a
12 specified durable nursery products for use by children under the age of five years.- }0 b1 i9 V: U) H8 }* ~3 F
The Act further requires that children’s product and its packaging should come with a tracking
, W" A \! q4 x& _9 B, f% H5 ~( ~$ {) ~label that allows officials to trace a product back to its factory in the event of a recall. Any
7 @8 |! i! ?, G8 D: Padvertisement for direct marketing shall carry appropriate cautionary statement for product that8 z) j! y8 o7 M
requires such information.% j/ z2 c1 o/ K4 g$ N
Civil penalties for violation of any CPSC regulations are increased from US$5,000 to# N+ A$ F5 c/ P0 s( \; B0 {
US$100,000 for individual violation or up to US$15 million for violations involving multiple
