The Consumer Product Safety Improvement Act of 2008 was legislated on 14 August 2008 that

The new Consumer Product Safety Improvement Act, due to be in force by stages, requires
$ X; a6 J2 J6 {, j8 Jmandatory third-party testing of products intended for children aged 12 and under covering a2 J2 l7 D/ Q/ k; P8 u3 Q8 O
broad spectrum of product categories, including toys, furniture, baby cribs, pacifiers, children’s4 ?* Z& {" N$ W; n( N0 o
metal jewellery, baby carriers, high chairs, strollers, walkers, swings and cradles.( |) d/ ?0 s+ G9 i" [6 H) X+ b
The Act will ban the sale of consumer products that contain excessive amount of following! b( v- \1 J M# Y
substances by the respective effective dates:8 c! z: q) ]% O( e
- Total lead content by weight for any accessible part of children’s product through( B( a& _: }2 O! f( z% R) w3 X
reasonably foreseeable use and abuse e.g. swallowing, mouthing, breaking, or other; Q5 Y0 R! L+ c
children’s activities, and the aging of the product:
5 K1 \- S" U) k3 T! ]8 M9 zo more than 600ppm (beginning 10 February 2009);: w2 y5 T! S/ g3 O
o more than 300ppm (beginning 14 August 2009);# B- C# ]% }: |' g* i
o more than 100ppm (beginning 14 August 2011);
6 x' e% y, H" @4 Y2 O9 [- Lead in paint and surface coating in max concentration of 0.009% or, more than 2μg: a: C* F" b, x# \4 X
of lead in a total weight ≤ 10mg of paint or other surface coating or in a surface area ≤
. G9 M( ~+ U' q" G! V1 ~6 q1cm2 (beginning 14 August 2009);
# b; d$ ^# e5 K. J& f: h4 B. J- Phthalates (DEHP, DBP or BBP) in concentrations exceeding 0.1% by weight of* [* \& E6 @3 q; U6 v7 m
children’s toy or childcare article, or phthalates (DINP, DIDP or DnOP) in$ h+ Y! X5 R: D7 @
concentrations exceeding 0.1% by weight of children’s toy that can be placed in a' E% o( a/ i" ]& B
child’s mouth or childcare article (beginning 10 February 2009).
. M0 s2 a- i8 W0 n/ y% I. aThe Act also specifies ASTM F963-07 Consumer Safety Specifications for Toy Safety as
* h+ s1 r) ^/ Z0 Fmandatory standard under the Consumer Product Safety Act and demands rulemaking process for
+ ~" `7 c1 X/ g4 z12 specified durable nursery products for use by children under the age of five years.
4 d0 O+ F/ @% u. I1 AThe Act further requires that children’s product and its packaging should come with a tracking" ^5 Y( z [1 }2 Q$ Q; T" q0 K5 U I4 A
label that allows officials to trace a product back to its factory in the event of a recall. Any
: M {2 w! U( h. Z4 \# \, yadvertisement for direct marketing shall carry appropriate cautionary statement for product that

Civil penalties for violation of any CPSC regulations are increased from US$5,000 to
/ R( L% b1 g! P, L% b5 qUS$100,000 for individual violation or up to US$15 million for violations involving multiple
