The Consumer Product Safety Improvement Act of 2008 was legislated on 14 August 2008 that7 [* y3 b" X0 D; K+ e6 N) [
regulates the manufacturing and testing of imported consumer goods in the US.9 l4 _. K$ X- d5 M
The new Consumer Product Safety Improvement Act, due to be in force by stages, requires
( y. v8 m- z8 t! Q( u" |' K% Fmandatory third-party testing of products intended for children aged 12 and under covering a Q1 h$ i k8 T6 t: l" Q" `
broad spectrum of product categories, including toys, furniture, baby cribs, pacifiers, children’s- h! C l3 q$ K3 E [
metal jewellery, baby carriers, high chairs, strollers, walkers, swings and cradles.3 e* m4 t( O. E: |% I t6 a
The Act will ban the sale of consumer products that contain excessive amount of following. v& s- ^' E6 T+ t( C7 p
substances by the respective effective dates:( U- A& w# n. V; w. v. \2 D j7 P
- Total lead content by weight for any accessible part of children’s product through
; \8 G1 N8 X0 M kreasonably foreseeable use and abuse e.g. swallowing, mouthing, breaking, or other
& R% N4 H9 \ C7 @children’s activities, and the aging of the product:

" G' _- v5 E! a8 b- @+ W! jo more than 300ppm (beginning 14 August 2009);

- Phthalates (DEHP, DBP or BBP) in concentrations exceeding 0.1% by weight of# `2 o$ k7 {. L, i% I6 m
children’s toy or childcare article, or phthalates (DINP, DIDP or DnOP) in
1 F8 S, W$ U3 r9 l0 H$ Y g4 wconcentrations exceeding 0.1% by weight of children’s toy that can be placed in a" W a( n* w3 o, p& s1 V1 @
child’s mouth or childcare article (beginning 10 February 2009).

The Act further requires that children’s product and its packaging should come with a tracking7 \. `7 s3 {+ s8 p" N- o3 S
label that allows officials to trace a product back to its factory in the event of a recall. Any0 B0 `4 K5 Y6 f' ]: m, L
advertisement for direct marketing shall carry appropriate cautionary statement for product that) S! \8 e' ~5 X1 o% `8 R/ R( p

Civil penalties for violation of any CPSC regulations are increased from US$5,000 to
