In order to ensure a high level of safety of toys for the EU markets, revision of the Toy Safety
R$ ?( X1 K) W% LDirective 88/378/EEC has been adopted by the European Parliament on 18 December 2008.
4 a* @: s3 e9 C) [" x% ]Publication of the revised directive on the Official Journal is expected in first quarter of 2009.
, f. x5 S' r& I- {$ kThe revision shall replace the current 20 years old toy safety directive that does not adequately0 @+ F$ E. ]% H: ]8 M2 o6 q
deal with the risks and dangers of newly toy designs.
! R" A0 R/ y7 t7 q7 QProvisions have been laid down for obligation of manufacturers, importers and retailers of toys,0 y+ q: W7 \; Z% W7 q
while the essential safety requirements of toys have much more related to the chemical properties

Obligation of toy manufacturers:/ A% |% A8 W) f& z: O3 h
a. To ensure their toys have been designed and manufactured1 l* {0 \- {) W
in accordance with the essential safety requirements;
/ s* x. [* Y2 {, Q3 qb. To draw up a complete product file for each toy and to carry, R9 q' d, X1 M; ]0 p1 ?
out conformity assessment prior to marketing of toy;, x5 d$ f6 S* ^0 S. L2 n. O0 G) j
c. To draw up an EC declaration of conformity based on the
8 P: O; d T3 v4 S% Zassessment procedure and affix the CE marking;) n6 y; Z8 F- w% [7 X
d. To have unique identification by type, batch or serial or model number or any other
3 [, j; a I, }: H, Jelement on the toy or packaging or document accompany the toy;1 e K$ a& m* |; ~4 d/ d) k
e. To accompany toy by appropriate safety warnings and instructions in a language or3 a$ s o, ?3 z7 L3 n5 p+ Y
languages easily understood by consumers;4 x# i4 {1 i" B3 T
f. To keep the technical documentation and the EC declaration of conformity for a period of3 _1 b/ N) }) ]9 S3 M v
ten years after a toy has been placed on the EU market (This also applies to the, I$ I, H8 B; R
authorized representatives and importers of toys);0 _; I I. H* ]; G& @& O; |1 j8 {
g. To indicate their name, registered trade name/mark and address on the toy or packaging or y m4 `! {; k; r% d7 {
document accompanying the toy (This also applies to the authorized representatives and
1 ]0 G" b/ d0 g; ]* \importers of toys).
# S2 y3 f& g" n: b8 d4 S" nEssential safety requirements of toys have been amended with following additions:
% z' ~ [+ u* sa. Where appropriate, toys shall bear warning label that specify appropriate user limitation.
F- Z6 W# g' V, A4 w: M* qHowever, warnings that contradict the intended use of the toy are prohibited, e.g. label
6 o6 Y4 J/ R$ v( a L+ x9 Klikes "Warning: Not for use by children under three years of age" on infant toys (e.g.& ^) {3 e: z/ e+ S- x
rattle) will not be allowed;
/ |$ T* L! ? ib. A toy intended for children under 36 months must be designed and manufactured in such
0 a' q' j- q8 M& oa way that it can be cleaned. A textile toy shall be washable, except if it contains a

c. Toys attached to a food product that must be consumed in order to get direct access to the& \: Q0 M4 D) Q- `' o
toy shall be prohibited, whereas toys contained within food or mixed with a food product
% ~" b, m+ ?7 [4 s3 t6 umust have their own packaging;
, [* j9 Z$ V, h- wd. Substances that are classified as carcinogenic, mutagenic or toxic for reproduction
4 y, O6 I. A* U( m5 e(CMRs), category 1A, 1B or 2 (except for nickel in stainless steel) shall not be used in% y8 d; p }# o+ F. B- ]+ R2 Z
