要看是什么类型的玩具，如果产品明显是在三岁以下年龄的小孩玩，那就算是包装上注明不适合三岁以下都不行。

Hi muhong, 同意你的观点，像牙胶摇铃这种不难判定是0+，但我们接触的玩具较多且复杂，是否有标准去区分三岁以上或以下的玩具？我的意思是，如果制造商坚持自己这个的设计是3+的，且已贴有WARNING, 是否有理据说服制造商回收产品。

( k7 c) j( A6 ?% V9 }因为我们平时看到很多年龄"3+" 的是有SMALL PART的，只要有WARNING 和相关标识，我们也相应当其是三岁以上的。而且也看过第三方测试报告，指出产品跌落测试产生SMALL PART 还是PASS了，只是备注一下，指出有”3+“ 标识，所以测试产生SMALL PART 不影响结果。

理解如下;1) 如 CPSC 工作人员(USA) 或各国玩具监管安全专业人员根据系统判定程序认为玩具的拟定对象是 3 岁以下儿
6 \* `. T, v$ w) I童，那么，不论用何标识，该玩具都必须符合《小部件条例》的要求。
7 L) C  K. }; N# f6 O( z         2）工厂或销售商为减免责任风险，而加贴年龄组标志，但错误凭主观去判定其产品的年龄段，应该当为无效, 所以这个年龄组标识应该由玩具设计人员充分熟悉自己产品后才决定是否应该应用，而不是当一个免责护身的手段。
' ?$ M4 C. M: {         3）本例中玩具颜色明亮鲜艳, 明亮颜色对三岁以下儿童有吸引力，且三岁下对轮动或滚轴驱动的简易小车或动物已有感知（约6 个月始），所以这例子应该属于三岁以下适用的产品，如果有违反小部件条例被要求回收是可以理解的。

如果是做包装时做的年龄标识，是不行的，不是你想写几岁就写几岁的。
至少要在公证行的评估下才能确定它的适合年龄。
$ J9 D3 L. N3 Z# B$ w出这种问题的关键在于年龄评估不谨慎。

The requirement that toys which due to their characteristics are generally considered as intended for children
under 36 months shall not contain small parts, should be observed strictly. The warning does not release the

be avoided as they reduce the effectiveness of such statements.
