The Consumer Product Safety Improvement Act of 2008 was legislated on 14 August 2008 that
9 g* R% z" D$ lregulates the manufacturing and testing of imported consumer goods in the US.
& i( q* `% E' P) P& NThe new Consumer Product Safety Improvement Act, due to be in force by stages, requires' c9 O2 h2 A* h6 J
mandatory third-party testing of products intended for children aged 12 and under covering a
_! @: K# B0 M8 I. R7 V' g; Z- C3 b' Mbroad spectrum of product categories, including toys, furniture, baby cribs, pacifiers, children’s
4 W$ T8 z5 a' L1 C: [4 S7 tmetal jewellery, baby carriers, high chairs, strollers, walkers, swings and cradles.: S" M4 f9 {* |8 I3 s4 l/ B% J+ k& h
The Act will ban the sale of consumer products that contain excessive amount of following
- p4 p) g! e) Csubstances by the respective effective dates:% h2 B2 \- l( v0 Z# K
- Total lead content by weight for any accessible part of children’s product through
% h( ^% t' X% l; s: L# |! w0 wreasonably foreseeable use and abuse e.g. swallowing, mouthing, breaking, or other
; h* g2 W1 A. _/ Ochildren’s activities, and the aging of the product:( f. W" ?; h5 [3 K% \
o more than 600ppm (beginning 10 February 2009);6 h, y+ ^3 P* ?8 ^6 R
o more than 300ppm (beginning 14 August 2009);3 o/ e( p6 b$ k
o more than 100ppm (beginning 14 August 2011);0 Y6 ~2 o3 @) T; n" |: {. ^
- Lead in paint and surface coating in max concentration of 0.009% or, more than 2μg
1 S& W+ i- Z1 n* A4 V$ Nof lead in a total weight ≤ 10mg of paint or other surface coating or in a surface area ≤7 d( {) ?8 O, b' n0 b
1cm2 (beginning 14 August 2009);' L: k% n/ ~8 E. f' z, b
- Phthalates (DEHP, DBP or BBP) in concentrations exceeding 0.1% by weight of( j* n6 r& B/ H n$ c
children’s toy or childcare article, or phthalates (DINP, DIDP or DnOP) in
; A' \% T* W. H. y) Rconcentrations exceeding 0.1% by weight of children’s toy that can be placed in a" q$ b9 u7 W! h
child’s mouth or childcare article (beginning 10 February 2009)., J! \- K9 p" {3 G
The Act also specifies ASTM F963-07 Consumer Safety Specifications for Toy Safety as
9 k5 s; V3 n( H; P3 c& r( `mandatory standard under the Consumer Product Safety Act and demands rulemaking process for
) m0 [. P, s4 W+ J0 L5 ?12 specified durable nursery products for use by children under the age of five years.; B6 y5 x1 c9 Z1 S- X& C
The Act further requires that children’s product and its packaging should come with a tracking7 T% q& Q5 G; y9 w. ` m2 s6 F6 O8 \: Z
label that allows officials to trace a product back to its factory in the event of a recall. Any) \2 j6 w! F# G! O
advertisement for direct marketing shall carry appropriate cautionary statement for product that3 t& K' M6 Y! \! y& n$ q) g
requires such information.
' Q- Y( S9 l/ h% X* b7 B2 N4 wCivil penalties for violation of any CPSC regulations are increased from US$5,000 to! h# m1 t/ u, c V, H5 r
US$100,000 for individual violation or up to US$15 million for violations involving multiple9 h6 N P0 ?7 }$ `
