2009/48/EC公布好久了，大家有看到关于它里面玩具定义修改后的guideline吗，大家都认为玩具定义修改后范围扩大了，到底扩大到什么范围呢，2009/48/EC的解释里面讲的也很模糊，现引用解释如下：1 V% T" n7 W$ q3 g- n% O$ E8 E0 q7 V7 ^
This Directive shall apply to products designed or intended, whether or not exclusively,
$ h. f- M, b. Z! F! A& I d* Mfor use in play by children under 14 years of age (hereinafter referred to as "toys").
) o- L- {1 E7 |Article 2 (1) defines the scope of the Directive, that is the products to which it applies.
: ^, _5 a- R+ f- x' P! S# t! JThe definition in article 2 (1), first subparagraph, provides the following criteria for( }& ]5 L4 o! b) g
deciding whether a product falls under the scope of the Directive:
1 I8 y G" W6 `- V6 B0 @ Any product or material designed or intended
. q' k1 a: a$ j8 i% r whether or not exclusively9 [: Y$ H4 R4 E9 w; r \+ F
for use in play
) f3 |2 k5 B+ ~/ Y ] by children under 14 years of age.
8 \) r' L( c, C$ `% r- SThe wording of this provision is slightly different than the definition in the 88/378/EEC
. B0 x5 d6 ]$ M3 R, I) E0 dDirective. However, the intention has only been to codify the practise under that
8 {$ V8 Q6 N, G& E7 X) jDirective, and not to change the material scope of the Directive from what it has been up4 T# ]" Q) l. V/ {$ z5 S
till now. The words “whether or not exclusively” have been added to the definition to" }! u& J. D2 i1 @5 n" b' B
indicate that the product does not have to be exclusively intended for playing purposes in
( F6 g# E+ @1 t& ^$ N; ]order for it to be considered as a toy, but it can have other functions as well. For
0 H& U6 T' [" X% Texample, a key-ring with a teddy bear attached to it is considered as a toy, or a sleeping# ]- X) _: O3 F9 p& X ~
bag in the shape of a soft filled toy. It was not the intention to imply that the standard for
4 V" o& r! U' ~trampolines for instance needs to take into account adults using the toy-trampoline. Other2 z4 J7 d, R0 F2 {+ X% a
examples of products with double function (door decorations, soft filled animal shaped9 E/ {" |7 c, [9 c
purses or backpacks,…) can be found in guidance document 11 on classification of toys( D( h& X, t9 d5 I$ f
intended for children above or under 36 months.
