The revision shall replace the current 20 years old toy safety directive that does not adequately: y, l$ P0 A" b3 ~! Y" u& J7 I
deal with the risks and dangers of newly toy designs. ! ?8 `' z. q: }0 q# |4 O+ z+ F- iProvisions have been laid down for obligation of manufacturers, importers and retailers of toys, 5 t4 f- C2 k. ?, i8 A4 iwhile the essential safety requirements of toys have much more related to the chemical properties2 M; D( v- e% q+ x: o
and labeling of toys. ( m! e3 ~( |% q- A; o! Q vObligation of toy manufacturers: , E& z. U& [" s5 ~: \a. To ensure their toys have been designed and manufactured$ M( h; @. h0 f( R0 b+ U
in accordance with the essential safety requirements;' d' ?% P& K0 a& V4 R7 c1 _
b. To draw up a complete product file for each toy and to carry3 f* x' D+ {3 R/ w# q/ K9 ]; j Q
out conformity assessment prior to marketing of toy;3 f; @( Q2 I1 w) V
c. To draw up an EC declaration of conformity based on the* A" y5 m s# j$ h. V: t3 J
assessment procedure and affix the CE marking;+ [7 z1 F( S) I, |. N2 B L7 Y/ o
d. To have unique identification by type, batch or serial or model number or any other+ d. W+ b2 a! X4 u9 p3 r) c2 s. i+ c
element on the toy or packaging or document accompany the toy; ; g0 k8 T, n* t% h& xe. To accompany toy by appropriate safety warnings and instructions in a language or) K5 i8 _1 n$ N" b- e* _0 ^
languages easily understood by consumers;# p0 j3 q7 B# E' [$ p S
f. To keep the technical documentation and the EC declaration of conformity for a period of 8 U* Y1 G5 |9 x7 Pten years after a toy has been placed on the EU market (This also applies to the, e- K2 X( V/ _$ d6 q8 A0 [
authorized representatives and importers of toys);# L# S5 h* D. L6 M) z, K" V) y
g. To indicate their name, registered trade name/mark and address on the toy or packaging or9 E% }' Z! q M7 R5 c8 j
document accompanying the toy (This also applies to the authorized representatives and( s. p' A9 F1 i: ~ F9 Q1 e1 { l0 A" W
importers of toys).+ U$ R o( }! d4 C. h
Essential safety requirements of toys have been amended with following additions: t% o P R, @7 [" W# p8 Y( x: qa. Where appropriate, toys shall bear warning label that specify appropriate user limitation.6 j, K0 E3 @" S5 c
However, warnings that contradict the intended use of the toy are prohibited, e.g. label7 y$ l8 K; i& z
likes "Warning: Not for use by children under three years of age" on infant toys (e.g.% y" N+ Z$ H( ?: A: I) U

toy shall be prohibited, whereas toys contained within food or mixed with a food product , b4 n# A. l, cmust have their own packaging;3 Y* K8 s; P# ^# f* p
d. Substances that are classified as carcinogenic, mutagenic or toxic for reproduction 7 [7 q& ?5 Z4 b' S3 W(CMRs), category 1A, 1B or 2 (except for nickel in stainless steel) shall not be used in. V7 H" p6 C4 G) _1 @' H

e. Nitrosamines and nitrosable substances are prohibited for use in toys intended for B& F6 E3 b/ D% zchildren under 36 months or in other toys intended to be placed in the mouth if the3 l0 D' \) M+ R. q4 \( v
migration of substances is ≥ 0.05mg/kg for nitrosamines and ≥ 1 mg/kg for nitrosable " y* _( t* I) hsubstances; 0 B, s' Q8 [, t# a& f( yf. Cosmetic toys shall comply with the compositional and labeling requirements of council 8 U y: B7 T2 w Y' uDirective 76/768/EEC; # b5 e! z" g1 |8 Kg. Toys shall not contain specific allergenic fragrances unless it is not avoidable in good ) J& J8 Q8 w+ T2 d1 a, dmanufacturing practice and does not exceed 100ppm;0 C" K" A% d2 W: J# C
h. Migration of following metals from toys or toy components accessible to children, when- U5 Q/ O/ m5 b7 i* j0 U, }
