The fixing system mentioned in 1.4.2.1 of machinery directive does mean that it's for the fixed guards, which got the chances ofprobably opened by the user.
Of course the damned guards are still guards.
But some of them are not required to be fixed by retained fastenings acc. to clause 1.4.2.1 of 2006/42/EC.
e.g. for some certain fixed guards on hedge trimmers, the user doesn't need to open them during the whole life time of the trimmers.
