European Commission Published Draft Proposal for RoHS and WEEE Directive
The European Commission (EC) issued “Proposal for a Directive of the European Parliament and of the Council on the restriction of the use of certain hazardous substances in electrical and electronic equipment (recast)” and “Proposal for a Directive of the European Parliament and of the Council on waste electrical and electronic equipment (WEEE) (recast)” on December 3rd, 2008 to revise the current EU RoHS (2002/95/EC) and WEEE (2002/96/EC).Summary of the RoHS proposed action:
• Two new annexes describing the directive scope are added which removed from current WEEE directive Annex I and IA.
• Medical devices and control and monitoring instruments are added in scope from 1st January 2014 and 1st January 2017.
• Manufacture shall draw up an EC declaration of conformity and affix the CE marking when placing their products on the market and shall keep the technical documentation and the EC declaration of conformity for ten years after the EEE has been placed on the market.
• When the substances listed in Annex III (i.e HBCDD, DEHP, BBP and DBP) have unacceptable risk to human health or the environment, arising from the use of substances, the list of prohibited substance in Annex IV shall be reviewed according Articles 69 to 72 of REACH regulation.
Summary of the WEEE proposed action
• The scope is clarified to the scope of the RoHS Directive.
• Annex I of Directive 2002/96/EC is deleted and a new Annex is added establishing minimum monitoring requirements for shipments of WEEE.
• WEEE a 65% collection rate set in function of the amount of EEE placed on the market in the preceding two years.
• Recovery and recycling targets are modified to include the re-use of whole appliances and the medical devices (the weight-based targets will increase by 5%). 欧盟执委会公布RoHS和WEEE修正草案
欧盟执委会于2008年12月3日发布了《电子电气设备中特定有害物质限用指令修正草案》以及《废弃电子电气设备指令修正草案》，旨在修订现行的欧盟RoHS(2002/95/EC)和WEEE(2002/96/EC)两大指令。
RoHS修正草案重点内容：
􀁺 将原先WEEE指令的附录I和IA新增为RoHS的两个附录；
􀁺 自2014年1月1日到2017年1月1日，逐步将医疗设备和监控设备纳入RoHS的管制范围；
􀁺 制造商需在产品上市销售之前制订EC符合性声明并加贴CE标志，且在电子电气产品上市之后，必须保留相关技术文件和EC符合性声明至少十年；
􀁺 如果附录III中列举的物质(如HBCDD、DEHP、BBP和DBP等)因使用对人体健康或环境造成无法承受的危害，则将依据REACH法规第69至72条的规定进行评估，进一步将此物质列入附录IV的限用物质。
WEEE修正草案的重点内容：
􀁺 删除2002/96/EC 指令中的附录IA和IB；
􀁺 新增废弃电子电气设备装运的最低监控要求；
􀁺 废弃电子电气产品需达到前两年市场销售总量65%的回收率(collection rate)；
􀁺 修改废物利用率(recovery)与再循环率(recycle)的目标(与原目标相比，修订后重量增加5%)，增加医疗设备的利用率(recovery)和再使用率(reuse)。
